Zoning Board of Adjustment

The Zoning Board of Adjustment is an advisory board to the Town Council.  The board hears and makes recommendations to the Town Council regarding:

Administrative Review - When it is alleged there is an error in an order, requirement, decision, or determination made by the Building Official in the enforcement of the zoning chapter.

Special Exceptions - A use that would not be appropriate generally or without restriction throughout a zoning district, but which, if controlled as to number, area, location, or relation to the neighborhood would promote the public health, safety, welfare, morals, order, comfort, convenience, prosperity, or general welfare.Such uses may be permissible in such zoning districts as special exceptions.

Variance - A relaxation of the terms of the zoning chapter where such variance will not be contrary to the public interest and where, owing to conditions peculiar to the property such as, but not limited to, the size of a lot, its topography, the conditions or nature of adjoining areas, which shall include water areas, or the existence of other unusual physical conditions, any of which are not the result of the actions of the applicant, a literal enforcement of the chapter would result in unnecessary and undue hardships. A variance is authorized only for height, area, and size of structure or size of yards and open spaces.
